Terms and Conditions of use of Portal UNIVERSATOR
By using or accessing UNIVERSATOR.com, the user agrees with the following terms and conditions of use:

Definitions
- The provider of the website: Universator, s.r.o., U vodarny 3032/2a, Brno, 616 00, Czech Republic, REG.NO: CZ29291861, VAT: 29291861.
- Unregistered user: a subject that uses the Portal UNIVERSATOR to search for information.
- Registered user: a subject that uses the Portal UNIVERSATOR to search for information, post information and/or communicate with other users within the website.
- School: a subject that uses the Portal UNIVERSATOR for the purpose of their presentation and communication with other users.
- User: every subject that uses the portal UNIVERSATOR for any purpose of use, i.d. unregistered users, registered users and schools.
- Portal UNIVERSATOR: the website www.universator.com, websites www.universator.ccTLD, where ccTLD (country code Top-Level Domain) is a national domain of a particular country in which the Provider provides a localized version of the Portal UNIVERSATOR.

Information about the Portal UNIVERSATOR and Recommendations to Users
- The Portal UNIVERSATOR is a global database of schools and their study programs, including social web features, that serves to high school and university students. The provider does not verify the verity and entirety of information inserted, he or she only allows registered schools to add their offer on the Portal UNIVERSATOR and registered users to add information about schools in the system or their own information.
- The provider does not enter in any way into legal relations between the users. The responsibility for the content of the communication between users, including the responsibility for arranged contract details, financial transactions and all other consequences is thus an issue of the users. The provider does not take any responsibility for the content and fulfilment of commitments arranged between users.
- The provider has no responsibility to verify updating, accuracy and verity of information inserted by users.
- The use of the internet constitutes some risk; therefore, it is necessary to pay attention to the nature of advertisements and contracts made on the internet. The provider recommends face-to-face contact between users: however, it is understood that face-to-face comunication between contracting parties is not feasible. In this case, the provider recommends to users to act with caution and deliberation when using the Portal UNIVERSATOR.
- The Portal UNIVERSATOR also contains links to other websites and third parties' sources that provide information to the users of the Portal UNIVERSATOR. The provider has no control over the content of those websites and sources, and thus takes no responsibility for the updating and accuracy of their content.

General Rules of Using of the Portal UNIVERSATOR
- The Portal UNIVERSATOR is designed
- to insert information about study opportunities by the schools and/or
- to insert information and experiences by students of particular schools and/or
- to search for information about the schools.
- Any use of the Portal UNIVERSATOR that may be incompatible with the purposes mentioned above is considered to be unauthorized behaviour. To protect the interests of users and the provider, it is especially considered as unauthorized the use of the Portal following actions and thus prohibited: any automated collecting of data and information; copying and saving information, data and images for other than personal use purposes; sending unsolicited information; contacting schools for other purposes than gaining further information about studies, including the clicking on premium list of programs by the users in the case they are not interested in studying at the school or in gaining further information.
- It is obligatory for the users to protect their passwords. In case of loss or misuse of the password, the users are obliged to inform the provider immediately in order for the provider to act appropriately. The Provider has no responsibility for possible harm caused by loss or misuse of the access data.
- Users that wish to use the UNIVERSATOR Portal as Registered users or School can register by filling in the registration form for Users or for Schools. These users are obligated to fill in only up-to-date and true information when registering.

Special Provisions Applicable to Schools
- It is obligatory for schools to insert only true and complete information about study opportunities. The school is not entitled to insert information that may harm other subjects in any way or that may be in conflict with the law or good manners.
- A person who inserts information on behalf of the school is committed to declare his/her identity on the provider's request. The person that inserts the information about the school on the Portal UNIVERSATOR explicitly declares that he/she is entitled to insert information on the Portal UNIVERSATOR.
- The School explicitly declares that it has all rights to insert materials, especially copyrights for the photo publishing. The School is informed about the fact that it is responsible for all damages and third parties' claims including court expenses that may be caused to the provider of the Portal UNIVERSATOR by violating the terms and conditions.
- An Advertiser is also committed to update inserted information properly, to provide up-to-date contact information and to communicate within appropriate periods of time.
- By inserting information on the Portal UNIVERSATOR, the school provides the provider with unconditional licence to use inserted information, including photos. The provider has a right to use the inserted data within its business, particularly for the promotion of the Portal UNIVERSATOR in either electronic or printed versions.
- The provider preserves the right to change design, logical structures, lay-out and functionality of the Portal UNIVERSATOR. Advertiser is committed to accept this right of the provider and not to demand any compensation or retribution for the cause of these changes.
- According to the point above, users shall fill in their contact details. Main contact person of the School is entitled to provide access to other side contact persons using the School registration form. These side contact persons shall have the same access to the UNIVERSATOR Portal as the Main contact.

Special Provisions Applicable to Registered Users
- In the case that a registered user wants to become the Universator, his/her name and photo will automatically appear among Universators of the school so that other users and schools can see him/her and contact him/her. In case of disagreement, the user can unregister himself/herself from the position of the Universator of his/her school.
- In the case that the user wishes to communicate in discussions with the other users on the website, the name and the photo of the contributing user will automatically appear next to his/her contribution. In case that the user will not agree with this, the user is not obliged to write any contributions to discussions.
- The provider records all logins and activities of the users. This information is being used to monitor the amount of usage and functionality. The information is stored individually so that the provider is then able to provide in return to the users on an individual basis which thus makes working with the Portal UNIVERSATOR easier and faster.
- By filling in the information about themselves and their study experience, the users give the provider automatically the right to publish this information on the website Universator.com. The users have the possibility to forbid displaying of their email address to other users in the profile settings.

Responsibility Limits
- The users are informed and agree with the fact that the provider is not responsible for damages based on, caused by or being a consequence of activities connected with the operation of the Portal UNIVERSATOR.
- The limitation according to the previous article is valid with the exception of the case when such an exception or limitation are prohibited by law.
- If any user is not satisfied with the Portal UNIVERSATOR, or does not agree with either any part of these terms and conditions of use or business model on which the Portal UNIVERSATOR is based on, then it is an exclusive right of every user discontinue the use of the Portal UNIVERSATOR.
- The provider reserves his right to change design, logical structures, lay out and functionality of the Portal UNIVERSATOR. The user commits himself/herself to accept this right of the provider and not to demand any compensation or retribution for the cause of these changes.
- Under any circumstances, the users and the provider negotiate the limitation of damage compensation that may be applied against the provider by virtue of operating the Portal UNIVERSATOR and related services as follows:
- The maximum amount of damage compensation can only correspond up to the amount of fees paid by the user to the provider in the last 12 months, but no more than 50 EUR.
- The provider is not responsible for any damages caused by inappropriate functioning of the Portal UNIVERSATOR such as destroying, damaging or loss of data, if these occurrences were caused by another person or as a consequence of an inevitable accident.

Protection of Personal Information Data
- The users provide the provider with approval of recording and processing of data filled in when using the Portal UNIVERSATOR or when sending personal registration, especially, but not exceptionally: name, surname, e-mail address, phone numbers (all previously mentioned data belong to the "personal information data" category in the following articles).
- The users agree with the processing of the personal information data by the provider for the purpose of fulfilling the rights and commitments of the mutual contract relations. The users agree with the provider to entrust another person to process the personal information data.
- The user declares that his/her personal information data is accurate and complete. At the same time, the user is informed about the fact that the approval of recording and processing of personal information data can be retracted at any time in the written form addressed to the mail address of the provider.
- The users agree with the receiving of information that is connected to the services provided by the provider on an e-mail address filled in by the user during the registration. The user is entitled to deactivate this service in the profile settings or by clicking on the link in the e-mail received at any time.
- The users agree with the receiving of information provided by schools which users have added in My schools or My programmes that is connected to the school or study programme on an e-mail address filled in by the user during the registration. The user is entitled to deactivate this service in the profile settings or by clicking on the link in the e-mail received at any time.

Cookies
- A cookie is a small file with data sent from the WWW server to the user's browser that places it on the user's computer's hard drive. With every next visit of the provider's server, the browser sends the data back to the server. After the approval of the cookie, once the file is added, the cookie helps to analyse the progression only on the web of the provider and informs the provider, when the user visits a particular site on UNIVERSATOR.com. Cookies allow web applications to respond to the individual needs of users, and help them to make the viewing of the web faster. Thanks to cookies, the web application can adapt its operations directly to the needs of users and thus make the using of the Portal UNIVERSATOR easier.
- Cookies are used by the provider to find out which pages are in use. That enables the provider to analyze data about the use of the website and enhance the website for the purpose of the adaption to the needs of users. The provider uses this data only for the purpose of the statistical and webpage analysis, and for further simplification and conformation to the users.
- Cookies help the provider to provide better service to the users by giving the possibility to monitor which pages the users find as useful and which not. Cookies do not give the provider access to the user's computer or to any information about the user, in any case, with the exception of those that the user consentingly shares with the provider.

Final statements
- The owner reserves the right to interrupt the operation of the Portal UNIVERSATOR for the period necessary to work on its maintenance and modernisation.
- Possible invalidity or inconsistency of particular statements of this contract has no impact on the validity of the rules as a whole.
- The user and the provider explicitly agree on any ideas, remarks or comments sent to the provider do not establish any rights or claims for the financial or other fulfilment from the provider to the user.
- The user and the provider explicitly agree on that their mutual contract relations will be subjected to the law of the Czech Republic.
- The user and the provider agree on solving mutual conflicts within the objective and territorial competency of the communal court according to the residency of the provider.
- These terms and conditions are valid from 01.10.2011 and are mandatory for the users of the Portal UNIVERSATOR.
- The Provider reserves its right to change these terms and conditions. The announcement of the changes will be sent via e-mail address provided in the registration form through the news section on the website UNIVERSATOR.com. The users have the right to refuse the changes during a period of 20 days since the announcement about the changes has been sent to the email address, otherwise, the updated terms and conditions become mandatory for the user.
